In order to provide its members a facility to follow up standard type of cases in European countries where SNB-REACT has no operational facilities, it has concluded agreements with specialised IP lawfirms. Purpose of these agreements are to allow members a consistent approach to follow up actions initiated by customs or police officers. Taking into account budgetary constraints of our members, we agreed on fixed fees set at a relatively low level.
In Poland, we have such an understanding with Wardynski Lawfirm
The understanding entails the following:
Criminal and customs matters (art. 11 of the Regulation 1383/2003)
First 5 hours of work, € 350
The activities typically include:
(i) filing applicable motions under customs procedure, arranging
samples, maintaining contacts with customs, police and other authorities ?
correspondence, telephone calls,
(ii) analysis of law that could apply, major evidence, and progress
and outcome of proceedings,
(iii) filing a motion for prosecution and monitoring progress of
proceedings until charges are filed, or
(iv) arranging the simplified procedure provided in art. 11 Council
Regulation 1383/2003, and
(v) supervising destruction of goods, as is provided in art. 11
Council Regulation 1383/2003.
